Mr. Alok Kumar, learned counsel for the applicant. 2. Mr. Chitrartha Kandpal, learned Brief Holder for the State. 3. The applicant – Mohammad Nabi, who is in judicial custody in connection with FIR/ Case Crime No. 515 of 2024, under Sections 8, 21 and 29 of NDPS Act, registered at P.S.- Ranipur, District Haridwar, has sought his release on bail. 4. In this case, an FIR was lodged 19.12.2024 alleging therein that on the information received by the informer, when Police party was on patrolling duty, after having suspect on three persons, who were doing some activities by turning on the flashlight of the mobile, Police team, using necessary force, caught them on the spot. When search was made, from all the three accused persons, namely, Muslim, Meharban and Imran, a total of 274.25 grams of smack was recovered from their possession. 5. Heard learned counsel for the parties and perused the records. 6. Learned counsel for the applicant would submit that the applicant has not committed any offence, he has been falsely implicated in the present case; he was not present on the spot and that the name of the applicant came into light on the statement of the accused-Muslim, who was arrested on the spot. 7. Per contra, learned State Counsel vehemently opposed the bail application and would submit that the offence alleged is of a grave and heinous nature. 8. Having considered the submissions, under the facts and circumstances of the case, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 9. Accordingly, the present bail application is allowed. 10. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned, subject the following conditions: - i) The applicant shall attend the trial Court regularly, and, he will not seek any unnecessary adjournment. ii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of this case. iii) The applicant shall not leave India without any prior permission of the trial Court. 11. It is clarified that if the applicant misuses or violates any of the conditions, imposed upon him, the prosecution will be free to move the court for cancellation of bail.
