2025:UHC:10693 SL. No. Dat e Office Not es, r epor t s, or der s or pr oceedin gs or dir ect ion s an d Regist r ar ’s or der w it h Sign at u r es COURT’S OR JUDGE’S ORDERS W PSS/ 4 6 6 / 2 0 2 4 Hon ’ble Man oj Ku m ar Tiw ar i, J 1. Mr. B.S. Negi, learned counsel for the petitioner. 2. Mr. Narayan Dutt, learned Standing Counsel for the State of Uttarakhand. 3. Petitioner is serving as Area Rationing Officer in Department of Food, Civil Supplies & Consumer Affairs. He was transferred from Ghansali, District Tehri Garhwal to Bageshwar on administrative ground, vide order dated 14.03.2024. 4. Learned counsel for the petitioner submits that petitioner was posted at Gular, District Tehri Garhwal and he never served at Ghanshali, therefore, stipulation made in the transfer order, to that extent, is incorrect. He further submits that there was no complaint or any adverse material against the petitioner, therefore, the remark that his transfer is made on administrative ground is also not sustainable. 5. Learned State Counsel submits that pursuant to interim order passed in this writ petition, petitioner is still serving at Tehri Garhwal and is serving in the Headquarter. 6. Since transfer order was passed on 14.03.2024 and pursuant to interim order, petitioner is still continuing at Tehri Garhwal, therefore, the ends of justice would be met, if petitioner is permitted to make representation to the 2025:UHC:10693 Commissioner regarding his transfer. 7. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to Commissioner, Food, Civil Supplies & Consumer Affairs regarding his transfer. If he makes representation within ten days from today, decision thereupon shall be taken within six weeks thereafter. For a period of eight weeks or till decision is taken in the matter by the Commissioner, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
