HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10298 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE PRASHANT KUMAR, J. 1. Heard learned counsel appearing on behalf of the parties. 2. In the present case, the petitioner is the daughter-in-law of the private respondent being the respondent No.7. 3. The petitioner submits that she has applied for a new electric connection in the premises where she is presently residing. However, there has been strong resistance from her father-in-law, who is the owner of the said premises. 4. Learned counsel appearing on behalf of the Electricity Distribution Company also submits that they are willing to provide a new electric connection to the petitioner, however, there is a sharp opposition from the respondent No.7, who is not allowing them to enter the premises to provide the electric connection. 5. It is to be noted that the Supreme Court, in a catena of judgments, has held that the right to electricity is a fundamental right and a tenant/ occupier/ trespasser also has a right to obtain electric connection as long as he/ she is in occupation of the premises. 6. In light of the above, we are of the view that the Electricity Distribution Company should take the assistance of the Station House Officer, Police Station Hasanganj, District Lucknow being the respondent No.3. If such an assistance is sought for by the Electricity Versus Counsel for Petitioner(s) : Krishna Gopal Counsel for Respondent(s) : C.S.C., Aprajita Bansal Pushpa .....Petitioner(s) State Of U.P.
