(ORAL) The petitioner-Company, by way of present revision petition filed under Article 227 of the Constitution of India, seeks setting aside of an order dated 03.10.2016 (Annexure P-4) passed by respondent No. 1 (Land Acquisition Collector, Urban Estates, Haryana, Gurgaon), whereby the claim of petitioner seeking apportionment of compensation was rejected; the operative part thereof is extracted hereunder:- “ Moreover, Collaboration agreements, being contractual in nature, the applicant company have alternate remedies to claim cost & damages, if any, suffered by the company due to acquisition of Land. However, application under Section-30 is not maintainable and there are not the sufficient grounds to refer the dispute to the court for adjudication. Thus, the application is dismissed and compensation amount may be released to the landowners as per their share mentioned in the revenue records. However in view of the statements of respondent, an amount at the Dinesh Kumar 2025.08.19 10:36 I attest to the accuracy and integrity of this document Civil Revision No. 8815 of 2016 (O&M) [2] rate of Rs 25 lakh per acre may be deposited in Fixed Deposit, so that in case the applicant company prefers an appeal then release of FD may be subject to the decision of appeal. However, in the absence of any appeal, the term of the Fixed Deposit will mature after the expiration of 3 month.
