HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW FIRST APPEAL FROM ORDER No. - 842 of 2009 Court No. - 20 HON'BLE SYED QAMAR HASAN RIZVI, J.
1. List revised. No one has appeared on behalf of the appellant while Shri Tarun Kumar Mishra, learned counsel for The Oriental Insurance Company Ltd./respondent no. 3.
2. Precisely the case of the appellant is that learned Motor Accident Claim Tribunal vide order dated 15.4.2009 in MAC No. 20 of 2006 (Jaspreet Singh and others Vs. Rajesh Kumar Singh and others) without appreciating the material evidence as available on record, has decided the claim petition, in a very hyper- technical manner.
3. The grounds taken by the appellant is that the learned Tribunal has ignored the cogent and concrete evidence approving beyond any reasonable doubt that the accident had taken place only on account of applying sudden break by the driver running ahead of the vehicle of the deceased resulting in the accidental death of the deceased.
4. Having perused the material available on record, this Court is of the view that there is no illegality or infirmity in the judgment and order dated 15.04.2009 passed by learned Motor Accident Claim Tribunal/Additional District Judge, Court No. 2, Gonda in MAC No. 20 of 2006 (Jaspreet Singh and others Vs. Rajesh Kumar Singh and others). Accordingly, the instant appeal being devoid of merits is dismissed.
