HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6462 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J.
1. Heard Sri Gyanesh Kumar Singh, learned counsel for the petitioner as well as learned Standing Counsel for the respondents.
2. By means of present writ petition the petitioner has sought direction to the respondents to restrain one Pratap (private individual) not to encroach over the land being Gata No. 336, which is shown in the site plan in red colour and also to demolish the pillars raised by the Pratap. Further prayer has been made by the petitioner to decide his pending representation.
3. From perusal of record, firstly it is noticed that Pratap, against whom writ has been sought by the petitioner is not a party to the present writ petition and it seems that there is boundary dispute between the parties for which purpose adequate provisions exist for moving appropriate application before the competent authority for demarcation of the land in question.
4. No such direction as sought by the petitioner for restraining any private individual can be passed by this Court in exercise of power under Article 226/227 of the Constitution of India, as they are private parties and not State. In case petitioner seeks to restrain any private individual, he shall initiate appropriate civil proceedings before the competent Court and seek order of injunction.
5. In view of above, present writ petition being devoid of merit is dismissed. November 7, 2025 A. Verma Versus Counsel for Petitioner(s) : Gyanesh Kumar Singh Counsel for Respondent(s) : C.S.C.
