Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 59 of 2024, dated 12.06.2024, registered for the commission of offences punishable under Sections 279, 337 and 338 of the Indian Penal Code (hereinafter referred to as IPC) and Sections 181, 187 and 196 of the Motor Vehicles Act, 1988 (hereinafter referred to as MV Act) at Police Station Gaggal, District Kangra, H.P. based on compromise effected between the parties. 1 Whether reporters of Local Papers may be allowed to see the judgment? 2. It has been asserted that the petitioner and the informant are neighbours. They have entered into a compromise without any influence from any person. They want to maintain cordial relations with each other. Hence, the petition. 3. The statements of the informant Gurbir Singh and the victim Shilpa were recorded on 02.12.2025, in which they stated that they had entered into a compromise with the petitioner voluntarily without any influence or coercion from any person and they did not want to proceed further with the matter after the compromise. 5. The FIR has been registered for the commission of offences punishable under Sections 279, 337 and 338 of the IPC. This Court has already quashed the F.I.R. registered for the commission of offences punishable under Sections 279, 337, and 338 of IPC in Sushant vs State of H.P. 2023 HLJ 531, Vikas Huda vs. State of H.P. 2023 STPL 3009, Kulwidner Singh vs Ankush Kumar 2023 HLR 384 and Nishant vs. State 2022 Suppl. Law Cases 45 based on compromise. This Court has quashed the FIR registered for the commission of offences punishable under Sections 181 and 187 of the MV Act in Suresh Kumar v. State of H.P. 2022 (1) Him L.R. (HC) 81, Vijender Mehta and another Vs. State of H.P. and another (2023) ACC 488 (H.P.) and Sandeep Kumar

State of H.P. and others II (2023) ACC 651 (H.P.), and these judgments are binding upon this Court. 6. Therefore, in view of these precedents, the present petition is allowed and FIR No. 59 of 2024, dated 12.06.2024, registered for the commission of offences punishable under Sections 279, 337 and 338 of the IPC and Sections 181, 187 and 196 of MV Act at Police Station Gaggal, District Kangra, H.P. and consequential proceedings arising out of the said F.I.R. are quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
