Heard Sri Ram Prasad Dwivedi, learned counsel for the petitioner. 2. By means of the present petition, the petitioner has prayed for the following relief: "To issue any order or direction to the Civil Judge (Pravar Khand), Shrawasti to decide the Application for Succession Certificate dated 13.03.2023 same is pending since 13.03.2023 (annexed as Annexure no.2 to the petition) before the Civil Judge (Senior Division) expeditiously in stipulated time period as this Hon'ble Court may deem fit and proper in the interest of justice." 3. It is submitted on behalf of the petitioner that on 13.03.2023, the petitioner filed an application under Section 372 of the Indian Succession Act, 1925 before the court of learned Civil Judge, Senior Division, Shrawasti praying for succession certificate in respect of the Estate of the deceased parents who died on 22.10.2021. The petitioner has pleaded in the petition that the concerned Court is running vacant causing delay in the disposal of the aforesaid petitioner's application. 4. It has been brought to the notice of this Court that now the Presiding Officer has joined and the Court has started functioning from 03.10.2025. 5. In view of aforesaid situation, this Court is of the view that no useful purpose would be served to keep the writ petition pending. Accordingly, without adverting to the merits of the case, the present writ petition is disposed of with a direction to the learned Civil Judge (Senior Division), District- Shrawasti to decide the said case having Case No. 10 of 2023 (Manoj Kumar Maurya versus Estate of Amresh and others), strictly in accordance with law, expeditiously and preferably within a period of six months from the date of production of certified copy of this order.
