Bora, learned State Counsel is present. On the last occasion i.e. 24.01.2025, there was no representation on behalf of the petitioner and the following order was passed:- “None appears for the petitioner on call whereas Shri R Dhar, learned State Counsel, Assam is present. This writ petition was instituted in the year 2015 with a claim for appointment on compassionate ground for a death which had occurred on 03.03.2001. Page No.# 3/3 Without even going to the aspect as to whether any direction can be issued after a lapse of more than two decades for consideration, this Court has noticed that there has been marked default on the part of the petitioner in appearing and the order sheets reflect a sorry state of affairs. It also transpires that noticing such continuous default, this Court vide order dated 19.02.2020 had dismissed the case for non-prosecution. Long thereafter, MC/6/2024 was filed for restoration which was allowed on 04.12.2024. Even today, there is no representation. Be that as it may, as an exceptional case, a final opportunity is granted to the petitioner to make representation and the matter be listed for consideration on 28.01.2025. It is made clear that in case of non-representation, this Court will be left with no other alternative but to pass appropriate order(s).” In view of the aforesaid facts and circumstances, this Court has no other alternative but to dismiss this petition for non-prosecution.
