Mr. D.K. Sharma, learned senior counsel assisted by Mr. Lalit Sharma and Ms. Suraiya Naaz, learned counsel for the applicant. 2. Mr. G.S. The present applicant Charanjeet Saluja S/o Sundar Das Saluja is praying for bail in reference to First Information Report dated 28.04.2025 bearing FIR No. 0199 of 2025 P.S. Rudrapur, District Udham Singh Nagar, wherein, two persons namely Avdhesh Kumar Saluja and Dinesh Kumar Saluja as well as one unknown person were implicated for the offences punishable under Sections 103(1), 109, 190, 191(2), 191(3) and 351(2) of BNS, 2023. On completion of the investigation in total nine persons including the present applicant have been chargesheeted for the offences punishable under Sections 103(1), 109, 351(2), 191(2), 191(3), 190, 3(5) and 61(2) of BNS, 2023. 4. Learned counsel for the applicant argued that the applicant is innocent and has been falsely implicated, which is evident from the fact that he is not named in the FIR and even during investigation the complainant has not disclosed the name of the applicant. 5. Apart from this he submits that the co- accused Hemant Saluja has been granted bail by this court on 26.09.2025 and praying for parity of co-accused Hemant Saluja. He further submits that the applicant is aged person and suffering from cancer and is languishing in jail since 29.04.2025. Apart from this, he submits that the applicant has no previous criminal history. The bail order of the co-accused Hemant Saluja is also placed on record as Annexure-3 and I peruse the same. Learned counsel for the applicant also 2025:UHC:11381 pointed out that the complainant was examined as PW1 and has been declared hostile. He also submits that the applicant was earlier granted short term bail on the ground of his medical ailment and on completion of short term bail he has surrendered and never misused the same. 6. Learned State counsel also fairly submits that the applicant deserves for parity of the co- accused Hemant Saluja, who was also not named in the FIR. He further pointed out that the trial has already been commenced and during trial the complainant has been declared hostile. 7. After hearing the arguments of learned counsel for the parties and taking into consideration that the applicant is 62 years old and is suffering from cancer and the trial has already been commenced and the other co-accused Hemant Saluja whose role is also identical to the present applicant is already enlarged on bail, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Charanjeet Saluja’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
