Mr. Anil Kumar Joshi, Advocate, for the petitioners. Mr. Ganesh Datt Kandpal, Deputy AG, with Mr. Rajeev Singh Bisht, Additional CSC, for the State. (2) Petitioners are serving in an educational institution, which was not receiving any financial aid from the State Government. State Government decided to include the institution, where petitioners are serving, in the grant-in-aid list vide Government Order dated 4.3.2014. Since petitioners are being paid salary in the pay scale admissible to teachers serving in government aided institutions w.e.f. 1.4.2017 and they are claiming said benefit with effect from the date of inclusion of the institution in the grant-in-aid list, therefore, petitioners have filed this writ petition seeking the following relief: “i) Issue a writ, order or direction in the nature of mandamus commanding the respondents to allow the salary grant to the petitioners from the date the institution “Janta Purva Madhyamic Vidhyalaya, Chitrkoot, Tiwari Nagar, Bindukhatta, District Nainital was taken into grant-in-aid of the State Government i.e. 4.03.2014 and pay the arrears of salary from 4.3.2014 to 31.03.2017.” (3) Petitioners have relied upon the judgments passed by coordinate Bench in WPMS No. 1820 of 2017 and Division Bench in Special Appeal No. 166 of 2019. (4) Learned State Counsel submits that petitioners have sought writ of mandamus without making any representation, which is essential for seeking such relief. 2025:UHC:11188 (5) Writ petition is, accordingly disposed of with liberty to petitioners to approach competent authority by making representation. If petitioners make representation highlighting their grievance within three weeks from today, decision thereupon shall be by the competent authority, as per law, within six months thereafter.
