By the present writ petition, the petitioner, who is working as Deputy Conservator of Forest at Sub-Division Gharghoda, Forest Division Raigarh, is seeking direction towards the respondent authorities/ Secretary, Forest, Environment & Climate Change Department, Raipur to decide the pending appeal (Annexure P/2) filed by the petitioner. 2. Learned counsel appearing for the petitioner submits that the appeal (Annexure P/2) was initially filed before his Excellency Governor of State which was forwarded to the respondent No.2 vide communication dated 10/01/2025 though after forwarding the appeal to the respondent No.2, the authority has not taken any steps to decide the pending appeal under Rule 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 (for short, “the Rules of 1966”) filed by the petitioner against the demotion order dated 26/11/2024. 3. Learned counsel appearing for the State submits that if the appeal preferred by the petitioner is still pending before the respondent No.2, the same shall be considered in accordance with law within the stipulated period. 4. I have heard learned counsel for the parties, perused the pleadings and the documents. 5. Looking to the facts and circumstances of the case and considering the fact that the appeal preferred by the petitioner is 3 / 3 still pending before the respondent authorities, the respondent No.2/ Secretary, Forest, Environment & Climate Change Department, Raipur is directed to decide the pending appeal preferred by the petitioner under the Rules of 1966, within a period of 60 days from the date of receipt of a copy of this Order. 6. With the aforesaid direction, the writ petition is disposed of. 7. The petitioner is at liberty to apprise the respondent authorities with regard to the order passed by this Court.
