In this petition, the petitioner seeks the following reliefs; "a) Issue a writ of certiorari, similar writ or order or direction, directing the Respondent No.1 to consider the request of the Petitioner and permit him to take - 3 - NC: 2025:KHC:12796 WP No. 5468 of 2025 an online examination to retake the exams to clear his backlog subjects. b) Declare that denying online examinations to a student with Progressive Multiple Sclerosis is unconstitutional and violative of the RPwD Act, 2016. c) Pass such Order / Orders this Hon'ble Court deems fit to grant in the circumstances of the case, in the interest of justice and equity." 2. Learned counsel for the petitioner would reiterate the various contentions urged in the petition and submit that the numerous requests / representations / notices etc., at Annexures - D, E, F, G and H submitted by the petitioner to the respondent No.1 - University for permission to appear in the online examination has not been considered by respondent No.1 and as such, the petitioner is before this Court by way of the present petition. 3. Per contra, learned counsel for respondent No.1 submits that if a reasonable time is granted, respondent No.1 would consider the same and take appropriate - 4 - NC: 2025:KHC:12796 WP No. 5468 of 2025 decision / pass appropriate orders on the aforesaid requests at Annexures - D, E, F and H submitted by the petitioner in accordance with law. 4. In view of the facts and circumstances, I deem it just and appropriate to dispose of the petition directing respondent No.1 to consider the grievance of the petitioner and pass appropriate orders / take appropriate decision on the requests / representations / notices submitted by the petitioner at Annexures - D, E, F and H without reference to Annexure G, within one week from today. 5. Liberty is reserved in favour of the petitioner to approach this Court subsequently if the occasion so arises. 6. In view of the aforesaid direction, the petition is disposed of.
