Mr. Anil Anthwal, Advocate, for the petitioner. Mr. Dinesh Bankoti, Brief Holder, for the State. (2) Petitioner claims that he earlier held O/ o Manager of Harlal Verma Inter College, Bhakura, Shyalde, District Almora, however he is not being permitted to participate in the election process, which is now being held pursuant to notification issued by Election Officer. In this writ petition, petitioners have sought the following reliefs:
“(i) a writ order or direction in the nature of certiorari quashing the impugned Election process of the Committee of Management of Harlal Inter College Bhakura District Almora pursuant to Election Scheme published by the respondent No. 4 in the newspaper (Annexure No. 9 to the writ petition) on the basis of the list of member for election of Committee of Management of 2025-26 approved on 14.10.2025. (ii) a writ order or direction in the nature of mandamus commanding the respondents to conduct the election of the Committee of Management only after including the list of 65 members including the petitioner who have already deposited their membership fees on 05.01.2019 pursuant to the advertisement published on 08.12.2018 published in the newspaper Amar Ujala for conducting the election of Committee of Management of Harlal Verma Inter College Bhakura District Almora.”
(3) Learned State Counsel was asked to get instructions. On instructions, he submits that the authorised controller of the concerned school had issued an advertisement in newspapers asking persons, desirous of becoming member of the society running the institution, to submit application between 21.1.2025 to
19.2.2025. The said advertisement is produced in Court, which is taken on record. 2025:UHC:11414 (4) Perusal of aforesaid advertisement reveals that public at large was informed that the term of persons inducted as member has expired, therefore everyone desirous of participating in the election process has to make fresh application for membership. Admittedly, petitioner did not make any application pursuant to said advertisement.
Thus the grievance raised by petitioner in this writ petition is without substance. Thus this Court do not find any reason to interfere with the ongoing election process. (5) Even otherwise also, law is well settled that once the election process is notified, ordinarily there should be no interference with such process, unless there are some special reasons for doing so. As discussed above, there is no such reason in the present case. Consequently, writ petition is dismissed. ( Man oj Ku m ar Tiw ar i, J.)
