District Education Officer DEO, Sanskrit Education, Jaipur ----Respondents For Petitioner(s) : Mr. Mahaveer Singh Sherawat For Respondent(s) : Ms. Deepa Singh for Ms. Manju Joshi-Addl.G.C. JUSTICE ANOOP KUMAR DHAND Order 07/04/2025 1. A limited prayer has been made by the petitioner in this writ petition for issuing a direction to the respondents to grant interest @ 9% per annum in terms of the Rule 89 of the Rajasthan Civil Services (Pension) Rules, 1996 (for short, ‘the Rules of 1996’) to him. 2. Counsel for the petitioner submits that the petitioner stood retired on 31.05.2011 and his retiral dues were withheld by the respondents till 03.09.2012 without any justified reasons. Counsel [2025:RJ-JP:15424] (2 of 2) [CW-6661/2013] submits that under such circumstances, the petitioner is entitled to get interest on the delayed payment of retiral dues. 3. Per contra, counsel for the respondents opposed the argu- ments raised by counsel for the petitioner and submitted that after retirement of the petitioner i.e. on 31.05.2011, the revised Pen- sion Payment Order was issued and the pensionary benefits were released to the petitioner in the month of September, 2012, hence the petitioner is not entitled to get any interest. 4. Heard and considered the submissions made at Bar and pe- rused the material available on record. 5. This fact is not in dispute that the petitioner stood retired on 31.05.2011 and the entire service record of the petitioner was available with the respondents. If at all the delay has been caused by the respondents in releasing the revised pay/revised pension of the petitioner, he cannot be allowed to make sufferer. Hence under these circumstances, the petitioner is entitled to get interest on the retiral dues @ 9% per annum in terms of Rule 89 of the Rules of 1996. 6. With the aforesaid observation, the present writ petition stands disposed of. 7. Needless to observe that compliance of this order would be made by the respondents within a period of three months from the date of receipt of the certified copy of this order. 8. All pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Ashu/254
