This writ petition has been filed under Article 227 of the Constitution of India, whereby the petitioner has sought a direction to be issued to the trial court i.e., Assistant Collector, Ist Class, Ram Nagar, Nainital, to expedite the hearing of Revenue Suit No.22/130 of the year 2019-20, Jeevan Ran and others Vs. Hari Ram and others. 4. It is contended by learned counsel for the petitioner that the partition suit is pending before the trial court since 2019-20, but from perusal of the order sheet, which has been annexed with the writ petition as annexure no.2, it transpires that still all the defendants have not been served and the matter is still listed for steps and filing of the statements. 5. In such view of the matter, it is not an appropriate case where such a direction can be issued. 6. Accordingly writ petition stands dismissed. (Pankaj Purohit, J.) 01.12.2025 SK
