Ms. No. 40 dt. No. 40 dt. 30.06.2017 and consequential proceedings in R.C. No. 90/PS-1/2010-3 dated 20- 07-2017, despite representations dated 01-08- 2024, 20-12-2024 and 21-12-2024 made by the petitioner as being arbitrary illegal and violative of Article 14 and 19 of Constitution of India and consequently direct the respondents 2 to 5 to permit the petitioner Institution to fill up 19 vacant Aided Teaching and Non- Teaching posts as per G.O. Ms. No 40 dt.30.06.2017 and consequential proceedings in R.C. No 90/PS- 1/2010-3 dated 20.07 2017 within a reasonable time and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 2 to 5 to permit the petitioner Institution to fill up 19 vacant Aided Teaching and Non Teaching posts as per G.O.Ms.No.40 dt.30.06.2017 and consequential proceedings in R.C. No 90/PS-1/2010-3 dated 20.07.2017 within a reasonable time pending disposal of the Writ petition in the interest of justice and pass Counsel for the Petitioner: 1. GP FOR SCHOOL EDUCATION 3 The Court made the following order: When the matter is taken up, it is brought to the notice of this Court by both the learned counsel that the issue in the present Writ Petition is squarely covered by the order in Writ Petition No.20062 of 2024, dated 15.11.2024. A copy of the said order is placed on record. Operative portion of the said order reads as follows: “…In accordance with the provisions of G.O.Ms.No.59, School Education (PS) Department, dated 22.06.2023, the competent authority, namely, 3rd respondent-Regional Director of School Education is directed to ascertain the availability of qualified surplus staff within the district and to allocate such surplus staff to the management/institution on a permanent basis. If no surplus staff is available, the competent authority shall inform the management/institution accordingly, permitting them to fill the vacancies in accordance with the rules prescribed in G.O.Ms.No.59 dated 22.06.2023 and G.O.Ms.No.1 dated 01.01.1994. It is to be understood that the process of the filling of the teacher posts shall be completed within a period of three months from the date of receipt of the order.” Following the above said order and for reasons recorded therein, the present Writ Petition is disposed in terms thereof.
