Acharya, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 18.03.2025 01. 1. Heard Mr. Mohapatra, learned counsel for the petitioners and Mr. Acharya, learned ASC for the State. 2. Instant petition under Section 483 BNSS is filed for release of the petitioners on bail in connection with T.R. Case No. 122 of 2024 (arising out of Sambalpur GRPS Case No. 141 of 2024) pending in the file of learned Sessions Judge-cum-Special Court, Sambalpur, on the grounds stated. 3. It is claimed that the petitioners to be the first-time offenders involved in illicit transportation of Ganja of 27 Kgs. The further submission is that chargesheet is filed in the meantime i.e. on 28th December, 2024. The petitioners, as further informed, have no similar criminal antecedents. The release of the petitioners is opposed by Mr. Acharya, learned ASC for the State on the ground that the recovery and seizure is in relation to commercial quantity of Ganja. Considering the same and recording the claim of absence of similar antecedents and custody of petitioners is since 1st October, 2024 and closure of investigation in the meantime, the Court, as the trial is unlikely to commence and conclude in near future, is inclined to allow them to go on bail with following conditions. 4. Accordingly, it is ordered. 5. In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioners are directed to go on bail in connection with T.R. Case No. 122 of 2024 arising out of Sambalpur GRPS Case No. 141 of 2024 subject to them furnishing bail bonds of Rs.40,000/-(rupees forty thousand) each with one solvent surety each for the like amount to the satisfaction of the learned Sessions Judge-cum-Special Court, Sambalpur, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. Such release of the petitioners, as it is further directed, shall be upon verification and absence of similar antecedents against them. 6. The BLAPL is disposed of. 7.
