Ilam Valuthi For Mr. S.Sivasubramani O R D E R The Writ Petition is filed for the following relief: “Writ of Certiorarified mandamus, to call for the impugned order of the I Additional Labour Court, Chennai in EP.No.7 of 2019 dated 26.08.2019 and quash the same and consequently direct the respondent to regularise the service of the petitioner with effect from 15.04.1999, the date on which the petitioner completed 240 days of continuous duty as per Section 25 B of the Industrial Disputes Act 1947”. 2. Earlier the petitioner had moved this Court for the following relief in W.P.No.35188 of 2015: “Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus 2/8 https://www.mhc.tn.gov.in/judis W.P.No.11230 of 2021 directing the respondents to regularise the appointment of the petitioner with effect from 30.04.1999 with all attendant and monitory benefits based on the representation made by the petitioner dated 15.04.2015”. 3. This Court by order dated 02.11.2015 had passed the following order: “5.Though the petitioner prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 15.04.2015 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.” 3/8 https://www.mhc.tn.gov.in/judis W.P.No.11230 of 2021 4. Suppressing these facts the execution petition has been filed by the petitioner.
