This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest, for offences under Sections 420, 467, 468, 471 and 120-B IPC. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The petitioner is the purchaser of the land which was allegedly sold through the power of attorney holders namely Rashid Ansari and Mustakim Ansari by impersonation. It is alleged that in place of the actual Principal, an imposter executed the power in favour of Rashid Ansari and Mustakim Ansari. Thereafter the power of attorney holder sold the land to this petitioner. 5. Since the petitioner is the purchaser of the land, it can prima facie be said that he has been cheated also. 2025:JHHC:19864 2 6. Considering the fact that the petitioner is a mere purchaser, this is not a case which needs custodial interrogation of the petitioner. Thus, I am inclined to allow this application. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M.F.C.-IV, Ranchi, in connection with Complaint Case No.10993 of 2022, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his / her name or in the name of his ancestors in which he / she is having share and to that effect, he / she has to file an affidavit before the Trial Court indicating his / her share in the property.
