Heard the learned counsel for the parties. 2. This petition has been filed by the petitioner for the following main prayer:- " I. Issue a writ, order or direction in the nature of Mandamus commanding the Opposite party nos.1, 2 and 3 to initiate steps to construct the Khadanja on the land of Abadi Village Kohara, Tehsil Sadar, District Sultanpur through its Pradhan within specified time and to protect the common rights of villagers in the interest of justice." 3. Learned Standing Counsel on the basis of instructions received from Block Development Officer, Kurebhar, Sultanpur, dated 07.11.2025 has argued that there is already an existing Rasta / Public way in the area in question. On the Spot Inspection was carried out and it was found that the petitioner's house is situated on Gata No.213Ga/3.714 Hectare which is Abadi area for the whole village. There is already an RCC road which is in existence in the abadi area of the village which is being used by the petitioner as well as other villagers. The petitioner wants a Rasta to be constructed from within Gata No.191 which is recorded in the name of Satya Prakash and others as Bhumidhar with transferable Versus Counsel for Petitioner(s) : Ashutosh Kumar Singh Counsel for Respondent(s) : C.S.C., Mohan Singh Amita Sharma .....Petitioner(s) State Of U.P.
