Heard learned counsel for the petitioner, Sri Saharsh, learned Additional Chief Standing Counsel for the State, Sri Suryakant Singh, learned counsel for the opposite party no. 3 and perused the record. Instant writ petition has been filed with the following main reliefs :- "I. Issue a writ, order or direction in the nature of mandamus commanding the respondents to consider and grant promotion to the petitioner to the post of Assistant Engineer from the date on which similarly situated juniors were promoted, together with all consequential service benefits strictly in accordance with law. II. Issue a writ, order or direction in the nature of mandamus directing Opposite Party No. 2 to consider and decide the petitioner's pending representation dated 22.09.2025 (as enclosed in ANNEXURE No.1) by passing a reasoned and speaking order within a stipulated time frame as may be fixed by this Hon'ble Court." After arguing at some length, learned counsel for the petitioner submits that the interest of justice would be sub-served if this Hon'ble Court may be pleased to give liberty to the petitioner to move a fresh representation before the opposite party no. 2/The Principal Secretary, Department of Housing and Urban Planning, Govt. of U.P., Lucknow and the opposite party no. 2 may be directed to consider and decide the same within the stipulated period of time, as may be fixed by this court. Be that as it may, without entering into the merits of the case,the petitioner is given liberty to move a fresh representation, while raising all his claims and grounds before the opposite party no. 2/ The Principal Secretary, Department of Housing and Urban Planning, Govt. of U.P., Lucknow within the period of 15 days form today and if such representation is moved within aforesaid period, the opposite party no. 2 is directed to consider and decide the same within further period of six weeks, in accordance with law.
