The present application filed on behalf of the petitioner seeks following prayers:- “a. allow the present application and revive the contempt petition for non compliance of order dated 23.05.2025 AND/OR b. Direct the Respondents to forthwith vacate and hand over peaceful and vacant possession of the premises being Quarter No. 22 measuring 115.38 sq. mts, in accordance with the undertaking given and the findings recorded in the Local Commissioner’s Report dated 03.04.2023 c. Award exemplary costs to the Petitioners, in favour of the charitable institution, for the wilful and deliberate disobedience of the orders of this Hon’ble Court and for unnecessarily prolonging the litigation process d. Pass such other order as this Hon’ble Court may deem fit in the interest of Justice.” This is a digitally signed order. Vide order dated 23.05.2025, the captioned petition was disposed of with the following directions:- “1. Mr. Sandiv Kalia, Advocate, is present on behalf of the respondent through VC and states that they are ready to handover the keys of property bearing Quarter No.22,which forms the subject matter of the impugned order dated 7th December 2022. They have already received a payment of Rs.7,50,000/- in this regard. As per the settlement, balance payment of Rs.20 Lacs shall be paid by petitioner to respondent. Time of handing over is fixed for30th May 2025 at 11:00 A.M. 2. Respondent shall remove their articles from the said property prior to the above-mentioned date so that vacant and peaceful possession of the said property is handed over.” 5. Learned counsel appearing on behalf of the applicant/petitioner submits that the respondents did not comply with the aforesaid directions despite the petitioner’s readiness to pay a sum of Rs. 20 lakhs. 6. Issue notice to respondents, on petitioner taking necessary steps, through all permissible modes, including electronic mail, if any, returnable on 05.12.2025.
