Heard learned counsel for the applicants, learned AGA for the State of U.P. and perused the record. The present petition has been filed for the following main reliefs:- I. Issue a writ order or direction in the nature of Habeas Corpus, commanding respondent no. 4 to produce the minor child, Kumari Gargi @ Ranjan, before this Hon'ble Court. II. Issue a writ order or direction to hand over the custody of the minor child to the petitioner-father, or pass appropriate orders in the interest of the child." Taking note of the facts, as pleaded in the present petition including that petitioner Anil Kumar through whom the present petition has been filed seeking custody of Kumari Gargi/detenue, has also approached the competent court of jurisdiction in terms of Guardian and Wards Act, 1890 and the said suit is pending as Original Suit No. 269/2025 (Anil Kumar Versus Babita Devi) before the court concerned, this Court is not inclined to entertain the present petition for the relief sought, quoted above. It is accordingly, dismissed with liberty to pursue the remedy availed before the competent court of jurisdiction, which shall be considered and decided expeditiously.
