Mohit Singh Alias Lakki And Another .....Petitioner(s) State Of U.P. Thru. Secy. Home Civil Sectt. Lko And Others .....Respondent(s) Arpit Singh And Another .....Petitioner(s) State Of U.P. Thru. Secy. Home, Civil Sectt. Lko. And Others .....Respondent(s)
dated 16.05.2024, bearing Case Crime/FIR No.0136/2024, for the offence under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 of D.P. Act, registered at Police Station Auras, District Unnao. It has been argued by the learned counsel for the petitioners that petitioners are innocent and they have wrongly been implicated in the case. The petitioners are brother-in-law and sister of the accused No.1- Mohit Singh and they have no concern with the matrimonial dispute of accused No.1 and respondent No.4 (complainant). The dispute is matrimonial in nature and there is every likelihood that the matter may be settled through mediation. Learned counsel for the petitioners further submitted that in Criminal Misc. Writ Petition No.3703 of 2024, this Court has issued notice to the respondent No.4 to explore the possibility of settling the matter amicably by referring to the Mediation and Conciliation Center of this Court and granted protection to the accused Mohit Singh @ Lakki and Sarojani Singh, who are husband and mother- in-law of the informant/respondent No.4. Therefore, similar protection may be granted to the petitioners as well. In the circumstances, connect and list this case with Criminal Misc. Writ Petition No.3703 of 2024.
Till the next date of listing, it is provided that the petitioners (Arpit Singh and Agreema Singh) shall not be arrested on the basis of the impugned F.I.R. dated 16.05.2024, bearing Case Crime/FIR No.0136/2024, for the offence under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 of D.P. Act, registered at Police Station Auras, District Unnao, subject to their co-operation in the investigation. "
4. Learned A.G.A., on the basis of telephonic instructions, submits that charge sheet No.32/2025 dated 04.02.2025 has been forwarded in the Court and the matter was also referred to the Mediation and Conciliation Center of this Court for mediation between the parties, however, the mediation between the parties has been failed, therefore, this petition has rendered infructuous. 5. In view of above, it appears that the petitioners are not interested in pursuing the matter. CRLP No. 3703 of 2024 2
