Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties/police authorities to conduct the fair and proper investigation in Case Crime No.0010 of 2024 Under Section 363 I.P.C. Police Station- Machhrehta District-Sitapur, in the interest of justice. ii. Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties/police authorities to take appropriate and legal action on the First Information Report dated 5.1.2024 lodged in Case Crime No.0010 of 2024 Under Section 363 I.P.C. Police Station-Machhrehta District-Sitapur during the course of Versus Counsel for Petitioner(s) : Sunder Lal, Shatrohan Lal Counsel for Respondent(s) : G.A. Smt. Shiv Kumari .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Others .....Respondent(s) investigation including the arrest of the accused and recovery of minor daughter of the petitioner, in the interest of justice." 3. Opposite party no.3-Station House Officer, Police Station Machhrehta, District Sitapur, shall file his personal affidavit with regard to active investigation made in the case, particularly in the light of order dated 22.3.2024 passed by this Court in Criminal Misc. Writ Petition No.2032 of 2024 (Annexure-1), by 10.6.2024 or be present in Court along with the entire case diary on the said date. 4. List this case on 10.6.2024. " 4. Learned A.G.A., on the basis of instructions dated 19.09.2024 received from Incharge Inspector, Police Station Machhrehta, District Sitapur, submits that Charge Sheet No.A-239 dated 31.08.2024 has been forwarded in this matter, therefore, this petition has rendered infructuous.
