Parties have filed a compromise deed dated 26.10.2021. 2. This is the first appeal which has been filed by the appellant against the impugned judgment and decree dated 25.11.2009 passed by learned First Additional District Judge, Bilaspur in Civil Suit No. 44-A/2006. The dispute in the present appeal is with respect to the specific performance of the contract dated 13.02.2006 which was executed in favour of the appellant Smt. Sundari Bai executed by respondent Nos. 1 to 6. The civil suit filed by the appellant/plaintiff for specific performance of the contract was dismissed, however, she was found entitled for refund of the advance amount paid by her towards the agreement. The respondent No.8 Ashish Agrawal is the second purchaser who has already purchased the said property from respondent Nos. 1 to 6. 3. During the pendency of the present appeal the parties have entered into compromise and deed of agreement dated 26.10.2021 has also been filed in the present appeal on 01.11.2021 and the terms and conditions of the said deed of compromise dated 26.10.2021 are re-produced hereinbelow: "1. यह कि ग्राम भैसबोड़ तहसील किबल्हा जिला किबलासपुर में स्थित अचल संम्पत्ति ृ कि" भूकिम जिसा खसरा नं. 19/1 रबा 0.80 एड़ स्थित हैं। जिस हेतु प्रम पक्ष एवं कि-तीय पक्ष े मध्य भूकिम संबंधी जिसकिवल मामला माननीय छ ीसगढ़ उच्च न्यायालय े समक्ष एफ.ए. नं. 29/2010 लंकिबत है। 2. यह कि दोनो पक्ष उक्त भूकिम े संबंध में आपसी समझौते े आधार पर माननीय उच्च न्यायालय में लंकिबत प्ररण ो नही चलाना चाहते है, इस हेतु दोनो पक्षार सहमत है। 3. यह कि उक्त भूकिम े संबंध में प्रम पक्ष भकिवष्य में किसी भी प्रार ा किसी भी न्यायालय े समक्ष बाद प्रतुत रता है तो यह अवैध एवं शून्य होगा।" 4. Now the present appellant does not want to dispute the sale deed executed in favour fo the respondent No.8 Ashish Agrawa by the respondent Nos. 1 to 6. She 3 further wants to withdraw the appeal filed by her. The respondent No.8 is having no objection if the appellant is withdrawing her appeal without any condition in terms of the settlement between the parties. 5.
