Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.414 of 2023, under Section 302 IPC, P.S. Hujoorpur, District Bahraich. 3. Cause of death, as per the postmortem report, is antemortem injuries which are five in number. 4. Learned counsel for the applicant argues that the applicant was not even named in the FIR and subsequently, based upon the mobile message sent on the phone of the deceased from the phone number of the applicant, the applicant was linked with the offence and a motive was alleged on the said basis only. 5. Learned AGA has opposed the bail application. 6. Considering the fact that there are no eyewitnesses to the incident who have supported the version against the applicant and the applicant is linked based upon a message coupled with the fact that the applicant is in custody since 18.10.2023 and has no criminal antecedents and trial has not even started, the applicant is entitled to be enlarged on bail.
