Heard Sri Ravi Prakash Singh, the learned counsel for the petitioner and perused the records. 2. By means of the instant petition filed under Article 227 of the Constitution of India the petitioner has challenged the validity of an order dated 09.05.2025, passed by learned Additional Civil Judge, Senior Division, Court No.24, Lucknow in Regular Suit No.551 of 2025, whereby an application under Order XXXIX, Rules 1 and 2 C.P.C. has been allowed. 3. The petitioner has got a statutory remedy of filing an appeal under Order XLIII, Rule 1 (r) C.P.C. available to him. 4. In view of availability of alternative remedy, this court is not inclined to entertain this petition, which is dismissed accordingly. November 13, 2025 Ram.
