Mr. Kurban Ali, learned counsel for the petitioner. 2. Mr. N.K. Papnoi, learned Standing Counsel for the State of Uttarakhand. 3. Petitioner was earlier serving as Chief Assistant. He was promoted as Administrative Officer and was transferred from the Office of District Education Officer (Elementary), Dehradun to the Office of Block Education Officer, Betalghat, District Nainital, vide order dated 03.12.2025. Petitioner has challenged said transfer order in this writ petition. 4. It is contended that petitioner was elected as District President of Educational Ministerial Officers Association, Dehradun only in October, 2025 for a term of two years, therefore, as per Government Policy, he cannot be transferred within two years of his election. 5. Learned State Counsel points out that petitioner was removed not only from the Office of President but also from the primary membership of the Association, therefore, reliance upon Government Policy, by him, is unsustainable. 6. Mr. Kurban Ali, learned counsel for the petitioner, however, submits that General Secretary is not authorised for 2025:UHC:10954 removing an office bearer from the Association, it is only the President, who can remove an office bearer and President of the Association died on 22.11.2025. 7. This Court is not inclined to go into the question whether petitioner is still holding the Office of President or not, as that is not the scope of this writ petition. 8. Since petitioner has challenged his transfer, therefore, without expressing any opinion on merits of the case, this Court thinks that ends of justice would be met if petitioner is permitted to make representation to the Competent Authority. 9. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to Director (Elementary) within three days from today. If he makes representation within stipulated time, Director shall take decision thereupon, as per law, within two weeks thereafter. It shall be open to petitioner to make representation through e-mail.
