1. Mr. Vinay Kumar, learned counsel for the petitioners.
2. Mr. Ganesh Kandpal, learned Deputy Advocate General for the State of Uttarakhand.
3. Petitioners are serving as Ward Attendant in Female Hospital, Haldwani, District Nainital, since last several years. They are aggrieved by order dated 15.11.2018 passed by Chief Medical Superintendent, whereby their claim for regularisation has been rejected on the ground that there is no vacancy available on the post of Group ‘D’ post.
4. Petitioners contend that they are serving as Ward Attendant since 2007; they have served for eighteen years, thus, earned a right to be considered for regularisation.
5. Since State Government has now amended the Regularisation Rules, vide notification dated 05.12.2025, therefore, this Court finds substance in the submission made by learned counsel for the petitioners that it is incumbent upon the Competent Authority to re-visit the issue in the light of amended Regularisation Rules.
6. Accordingly, the writ petition is disposed of with a direction to Chief Medical Superintendent to re-consider claim of petitioners for regularisation in
2025:UHC:11184 terms of applicable Rules, within three months from the date of presentation of certified copy of this order.
