Heard learned counsel for the applicants and learned A.G.A. for the State. 2. The present application is filed with the prayer to quash the entire proceeding of Criminal Case No.41491 of 2025, (State vs. Jabir Ali and others) under Sections 3(5), 115(2), 352, 351(3), 117(2), BNS., pending before Additional Chief Judicial Magistrate-II, Hardoi. Police Station Kachchauna, District Hardoi. 3. Learned counsel for the applicant submitted that applicant has been falsely implicated in the present case only with an intention to to make pressure on the applicant as civil dispute is going on between them. Leaned counsel further submitted that one criminal case was also lodged from the side of applicant against the private respondent. In retaliation, the case in question was lodged and he further submitted that all injuries are fabricated one, therefore, kind indulgence of this court is necessary. 4. Learned AGA vehemently opposed the prayer of the applicant and submitted that medico-legal report reveals that there is a hair line fracture of parietal bone of skull and all these injuries as well as the prosecution case cannot be examined at this stage. 5. Considering the submissions of learned counsel for the parties and going through the contents of the petition as well as other relevant material, no case for interference is made out. Accordingly, application is misconceived and is hereby, dismissed.
