GP FOR FINANCE PLANNING The Court made the following ORDER: Heard Smt.P.Rachana, learned counsel for the petitioner, Sri Rasheed Basha, learned Assistant Government Pleader for Roads & Buildings for respondents 1, 3 to 5 and Smt.Naga Chandrika, learned Assistant Government Pleader for Finance for 2nd respondent. 2. The above writ petition is filed to declare the action of respondent authorities in not releasing the amount of Rs.3,34,800/- for the works i.e. “Construction of VVPAT’s storage in Guntur”, in pursuance of Agreement dated 20.06.2018, as illegal and arbitrary. 2 3. Learned counsel for the petitioner would submit that the petitioner and the 5th respondent entered into the aforementioned agreement, in connection with construction of VVPAT’s storage in Guntur. The work was completed and the same was certified by the Deputy Executive Engineer, (R&B) M&H Sub Division, Guntur dated 02.02.2019. However, the amount was not released so far. 4. Learned Assistant Government Pleader submitted the instructions of the 5th respondent. Para 2 of the instructions, relevant is extracted hereunder: “In this regard, I submit that Ls 1st and Final Bill for Rs.3,34,800/- (gross Amount) and Rs.3,06,390/- (Net Amount) was uploaded vide NIDHI Token No is not generated and same has approved by Pay and Accounts Officer and bill status showing is “Bill pending at Division office due to insufficient funds” with Finance department.” 5. Thus, as evident from the instructions of the 5th respondent, there is no dispute regarding the completion of the work or the petitioner's entitlement for an amount of Rs.3,06,390/- (Net amount). 6. Given the facts and circumstances of the case, the writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, directing the respondents to release the amount of Rs.3,06,390/- (Net amount) in relation to the aforementioned work within two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.
