HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 11360 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Vakalatnama filed by Shri Sushant Kumar Misra, Advocate on behalf of the complainant is taken on record. Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State as well as perused the record. The accused-applicant seeks bail in Case Crime No.0269 of 2025 under Section 319(2), 318(4), 338, 336(3) and 340(2) BNS 2023, Police Station Salon, District Raebareli. The allegation in the prosecution case is that the applicant, along with the co-accused, impersonated themselves as Vindeshwari and Shiva Patel on the basis of forged Aadhaar and PAN cards, by affixing their photographs on those documents, and thereafter purchased an e- rickshaw from the complainant’s firm and also availed a loan from the concerned finance company. After coming to know the forgery during the process of realization of the installments, the company New Riding Enterprises lodged the FIR through its proprietor.
Learned counsel for the applicant submits that the applicant has not taken any loan from IndusInd Bank nor has he taken any loan through the complainant firm. It is further submitted that the applicant Versus Counsel for Applicant(s) : Shishir Pradhan Counsel for Opposite Party(s) : G.A. Sanjay Shukla .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s)
has not submitted any PAN card or Aadhaar card, and no complaint has been registered by IndusInd Bank against him. The offence is triable by a Magistrate. The applicant has also explained the criminal history of two cases in paragraph 15 of the bail application. It is further submitted that there is no possibility of the applicant of fleeing away after being released on bail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. as well as learned counsel for the complainant have opposed the bail prayer of the applicant but could not dispute the
facts mentioned above.
Learned counsel for the complainant submits that the applicant along with the co-accused, committed forgery and availed the loan from IndusInd Bank through the agency of the complainant. I have considered the arguments advanced by learned counsel for the parties as well as perused the record. On due consideration of the facts that the offence is triable by a Magistrate, the charge sheet in this case has been filed, the applicant is in jail since 25.09.2025, and also considering the pleadings made in paragraph 9 of the bail application, and without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. Let the applicant Sanjay Shukla, involved in the aforesaid FIR/Case crime number, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses;
BAIL No. 11360 of 2025 2
(iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
