2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the offences alleged against the accused- petitioners are exclusively triable by Magistrate. The accused- petitioners are in custody since 23.01.2025 and 05.05.2025 respectively and the trial of the case may take considerable time and the charge-sheet against the petitioners have already been produced, therefore, these bail applications of the accused- petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed these bail applications and contended that the petitioner Imran was caught red-handed at the place of occurrence and on his instance, the stolen articles were recovered. The other petitioner Mohammd Naim was able to fled away from the place of occurrence, however, he was arrested thereafter on 05.05.2025 and both the petitioners have committed theft in the house of complainant. There are other 5 similar nature of cases pending against the accused petitioner Mohammad Naim and 11 cases pending against the petitioner Imran, in different police station, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the fact that the offences alleged against the accused-petitioners are exclusively triable by Magistrate, the accused-petitioners are in custody since 23.01.2025 and 05.05.2025 respectively and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. [2025:RJ-JP:33166] (3 of 3) [CRLMB-5815/2025]
6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely:
1. Imran S/o Imamuddin and 2.
