2.
Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is contended that the other similarly placed co-accused namely- Monu, Bholu Sharma and Suraj, have been enlarged on bail by Coordinate Bench vide order dated 15.07.2025. It is further
[2025:RJ-JP:30685] (2 of 3) [CRLMB-5759/2025] contended that prima facie offence under Section 110 of BNS is not made against the petitioners. The injuries sustained to injured Upendra Sharma are neither at the vital part nor dangerous to life. The petitioners are in custody since 22.03.2025 and the charge- sheet against the petitioners have already been submitted before the concerned Court and trial of the case may take considerable time. The Police after investigation did not find the commission of offence of robbery, therefore, the bail application of the accused- petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail application. It is contended that against the petitioner-Manish Lodha a criminal case is already pending in FIR No.322/2024 registered at Police Station Mahila Thana Dholpur, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. Considering the arguments advanced by learned counsel for the petitioners and looking to the fact that the other similarly placed co-accused namely Monu, Bholu Sharma and Suraj, have already been enlarged on bail by the Co-ordinate Bench vide orders dated 15.07.2025, therefore, this Court deems it proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioners-

The accused-petitioner – Manish Lodha is also directed to mark his presence on 25th of every month before the concerned Police Station till conclusion of the trial. The SHO of the concerned Police Station is directed to maintain a regular register marking the presence of the accused petitioner and shall send the presence report of the accused petitioner on the same day to the concerned trial Court every month without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioners for cancellation of the bail before the concerned Court.
