This present writ petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “1. Admit to the writ petition; ii. Call for the relevant record from the custody of the respondents; iii. Issue RULE calling upon the respondents to show course why a writ of Mandamus and/or in the nature shall not be issued directing the respondent to refund the admitted total security deposit Rs.4,56,417/- Rs. Four Lakh Fifty Six thousand four hundred seventeen) and the admitted of dues of 1 RA bill Rs. 61,038 including admitted dues final bill amounting to Rs.36,97,3349/-. In total admitted final bill amounting to Rs. 42,14,804/- (Rs. Forty Two Lakh Fourteen thousand Eight Hundred Four)to the petitioner for the satisfactory completion of work namely "Collection, Transportation and supplying of pea gravels articles of approved quality of size range over 2.00mm to 4.75mm.best quality of Durgapur, west Bengal to the Departmental store yard at Ambassador surface water treatment plant, Kulai during the year 2020-2021(Group-1)." iv. After hearing the parties being pleased to make rules issuing direction to the respondents; AND Pass such other or orders, further order and direction/directions as deem fit and proper for the interest of justice.” 2. Heard Mr. B. Debnath, learned counsel appearing for the appellant as well as learned Government Advocate appearing for the respondents. 3. It is the case of the petitioner that on completion of the works, the respondents are not paying the bills. 4. It is seen from the record that the petitioner vide a demand letter dated 02.09.2025 requested the respondent No.3 to release the security deposit money and balance amount of his bill. But till date, the same is pending before the respondents without any consideration or reply. Hence this present writ petition. 5. Mr. Kohinoor N. Bhattacharyya, learned G.A., represents that it a Central Government Scheme and unless the funds are released to State by the Central Government, the amounts cannot be released and the State is awaiting for funds. He further contended that the Union of India has not been party in this present writ petition. He prayed to dismiss this present writ petition. 6. Accordingly, the respondents are directed to consider the demand letter dated 02.09.2025 submitted by the petitioner in accordance with law within a period of 3(three) months from the date of receipt of the copy of this order and after consideration, communicate their decision/reply to the petitioner herein. This writ petition is disposed of without making any opinion on merits. 7. With the above observation and direction, this present writ petition stands disposed of.
