HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 483 No. - 956 of 2025 Court No. - 34 HON'BLE TEJ PRATAP TIWARI, J. Heard Mr. Kaushal Mani Tripathi, learned counsel for the applicant, learned A.G.A. for the State of U.P. and perused the record. By means of the instant criminal miscellaneous petition, the petitioner has approached this Court with a limited prayer that the proceedings pending before the Court of learned Chief Judicial Magistrate, Lucknow in respect of Criminal Case No.1220 of 2012 (State vs. Shiva Kant Mishra & Others) arising out of Case Crime No.654/2011, under sections - 420, 406, 506 IPC, police station - Hazratganj, Lucknow may be decided expeditiously or within stipulated time which this Court may deem fit. It has been submitted by the leaned counsel for the applicant that despite the matter being fixed at the stage of evidence the cross examination is lingering which is causing injustice. It is noteworthy that vide earlier order dated 28.02.2020 of this Court, passed in Criminal Miscellaneous Case No.1354/2020 (Dr. A. Kannan vs. State of U.P. & Others) the Court has directed to expedite the proceedings and decide the same within four months from the date a certified copy of this order is placed before the learned trial court but despite the aforesaid direction the said case is still pending till date and no any substantial proceeding is seen by the learned trial court. It is very unfortunate that despite time bound order of this Court the learned trial court has not acted in compliance of it. In light of the above, the learned trial court is directed to decide the matter in question within a period of six months from the date a certified copy of this order is placed before it.
