Judgment on Board 28/07/2025
1. The appellant/insurance company has preferred this appeal under Section 173 of the Motor Vehicles Act calling in question the legality, validity and correctness of the impugned award dated 29.01.2022 passed by the learned Sixth Additional Motor Accident Claims Tribunal, Durg in Claim Case No.486/2019 whereby an amount of compensation of Rs.99,115/- has been awarded to the claimant in respect of the injuries sustained by him along- with interest at the rate of 7% per annum from the date of filing of claim application.
2.
Learned counsel for the appellant/insurance company would submit that the amount of compensation awarded to the claimant is at higher side, therefore, the appeal deserves to be allowed.
3
3.
Learned counsel for the respondent No.1/claimant would support the impugned award and submit that the learned Claims Tribunal has rightly awarded the compensation to the claimant, therefore, the appeal deserves to be dismissed.
4. I have heard learned counsel for the parties, considered their rival submissions made herein-above and went through the records with utmost circumspection.
5. After hearing learned counsel for the parties and after going through the records, I do not find any illegality in the impugned award as the amount awarded under different heads as discussed in para 33 of the impugned award is just and proper. Accordingly, I do not find any merit in this appeal, the same deserves to be and is hereby dismissed. The parties shall bear their own costs.
