HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 2848 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned AGA for the State. Whereas, no one has put in appearance on behalf of the informant. 2. The accused-applicant seeks bail in FIR/Case Crime No.148 of 2024 under Sections 103, 307, 331, 331(8), 317(4) BNS P.S.- Maharajganj Tarai, District- Balrampur. 3. It is argued by the learned counsel for the applicant that no one was named in the FIR. Subsequently, the applicant was made accused based upon the confessional statement and recovery was not done in presence of any independent witness. It is argued that on the same allegation, the co- accused has been enlarged on bail. Regarding the criminal antecedent of the applicant, it is argued that the applicant is on bail in all the cases levelled against him. However, it is further clarified that the applicant has been falsely implicated and simultaneously, four or five cases have been lodged against him on the basis of apprehension. 4. Learned AGA has opposed the bail application. 5. Considering the fact that the co-accused has already been enlarged on bail and the applicant is on bail in all the cases, he has been made accused and the recovery in the present case has not been made in the presence of any independent witness coupled with the fact that who is in custody since 22.11.2024, I am of the view that the applicant is entitled to be enlarged on bail.
