W PMS/ 3 3 5 2 / 2 0 2 5 Hon’ble Manoj Kumar Tiwari, J. Mr. Shobhit Saharia, Advocate for the petitioner. Mr. V.K. Kohli, Senior Advocate assisted by Mr. Dharmendra Barthwal and Mr. Kanti Ram, Advocates for the respondents. 2. Petitioner is running an iron bar manufacturing unit at Kichha, District Udham Singh Nagar. According to him, as per Uttarakhand Electricity Regulatory Commission (UERC) Regulations, he is liable to pay electricity bills every fifteen days; however, he is being charged on monthly basis in violation of UERC Regulations. The reliefs sought in the writ petition are as follow:
“i. Issue a writ, order or direction in the nature of mandamus commanding the respondent to accept and raise the electricity bills of the petitioner company on 15 days billing cycle basis and to recalculate the security deposit amount on the basis of 15 days billing cycle which comes to an average of one-month electricity bill for last 12 months and as per the calculations given by the respondent themselves equal to Rs. 2,36,39,273.21 and which is in excess of Rs. 1,50,14,983.28 of the security amount already deposited with the respondents (equal to Rs. 3,86,54,256.49). ii. Issue a writ, order our direction in the nature of mandamus commanding the respondents to adjust the excess additional security deposit of Rs.1,50,14,983.28, with the bill of the petitioner for the month of October 2025, which is Rs. 94,43,537.95 and to further adjust Rs. 47,21,769 in the month of November 2025 bill and which would still leave the respondents with an excess amount of Rs. 8,49,676.33. 2025:UHC:10976
iii. Issue any suitable order or direction of any nature which this Hon'ble Court may deem fit and proper.”

Having regard to the reliefs sought in the writ petition, this Court thinks that ends of justice would be met if petitioner is permitted to approach the competent authority by making representation. 4. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the competent authority within 48 hours. If he makes representation within stipulated time, decision thereupon shall be taken within two weeks thereafter. 5.
For a period of two weeks or till decision is taken on petitioner’s representation, whichever is earlier, additional security shall not be demanded from petitioner. (Manoj Kumar Tiwari, J.) 10.12.2025 Mahinder/
