Goswami, learned Additional Public Prosecutor for the respondent State. The instant criminal petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita [BNSS], 2023 is preferred by the three petitioners after receipt of a notice to appear in person or through duly engaged counsel before the Court of learned Additional Chief Judicial Magistrate, Dhubri in connection with Case no. 179/2025, instituted by one Mafuja Begum by way of a complaint before the said Court. After hearing the learned counsel for the parties at some length, Mr. Khan, learned counsel appearing for the petitioners has submitted that the petitioners would like to exhaust the remedy provided in the first proviso to sub-section [1] of Section 223 of BNSS before resorting to other remedies available under the law, if found aggrieved thereafter. In view of such submission made by Mr. Khan, learned counsel for the petitioners, this criminal petition is closed, reserving the liberty to the petitioners to approach the Court of Additional Chief Judicial Magistrate at Dhubri for availing the opportunity of being heard provided in the first proviso to sub-section [1] of Section 223 of BNSS.
