Kumar, learned counsel appearing for the petitioner and learned G.P. for Land Acquisition appearing for the respondents. 2. The petitioner claims ownership over Ac.4.35 cents in Sy.No.747/2 of Valasapalli Village, Mandanapalli Mandal, Chittoor District. She states that Ac.3.01 cents out of Ac.4.35 cents of land was taken over for Handrineeva Sujala Sravanthi Canal, without acquiring the land and without 2 RRR, J W.P.No.12064/2015 paying any compensation to her. She contends that proof of her ownership over the land, Pattadar Pass book and title deed was issued, vide account No.303 and Pattadar Pass Book No.332003 issued in her favour. She also relied upon two service connections issued in her favour in relation to this land. The 3rd respondent-Sub-Collector, Land Acquisition, does not dispute the fact that the land had been assigned to the husband of the petitioner. However, the 3rd respondent contends that the land of the petitioner was never requisitioned and as such no compensation need be paid to her. 3. In the circumstances, this writ petition is disposed of with the following directions: 1. Respondents 3 and 4 shall demarcate the land of the petitioner existing in Sy.No.747/2 of Valasapalli Village, Mandanapalli Mandal, Chittoor District, within a period of one month, from the date of receipt of this order, and handover possession of the said land to the petitioner. 2. In the event of failure to handover the land to the petitioner within a period of one month from the date of receipt of this order, the petitioner shall be entitled to compensation @ Rs.5,000/- per month till the land is handed over to the petitioner. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed. _______________________ R.
