G.A. cum PP Ms. Manju Dave, AGA HON'BLE MR. JUSTICE MANEESH SHARMA (V. J.) Order 17/06/2025 1. The instant bail application has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of the petitioners, who have been arrested in connection with FIR No.51/2025 registered at Police Station GRP Ajmer, District Ajmer for the offences punishable under Sections 8/ 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and the alleged recovered contraband is below commercial quantity; there are no previous criminal antecedents of the petitioners and the [2025:RJ-JP:23312] (2 of 3) [CRLMB-5755/2025] charge-sheet has already been filed; petitioners are in judicial custody since 16.04.2025; the trial of the case will take considerable time, therefore, further custody of the petitioners would not serve any fruitful purpose and petitioners be released on bail. 3. Learned Additional Government Advocate has opposed the submissions made by the learned counsel for the petitioners. 4. Heard learned counsel for both the parties and perused the material available on record. 5. Having regard to the totality of the facts and circumstances of the case, considering the arguments so advanced by the learned counsel for the petitioners, as also the fact that the alleged recovered contraband is below commercial quantity; the charge-sheet has already been filed, considering the fact that petitioners are in judicial custody since 16.04.2025 and that the trial of the case may take considerable time, thus, without commenting any opinion on the merits/demerits of the case, I deem it just and proper to allow this bail application. 6. Accordingly, the bail application under Section 483 Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and it is ordered that the accused-petitioners Govind Rao S/o Devilal and Govind Gir S/o Tejgir shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) each together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the court [2025:RJ-JP:23312] (3 of 3) [CRLMB-5755/2025] concerned on all the dates of hearing and as and when called upon to do so. 7. It is made clear that the petitioners shall not involve themselves in any offence(s) of similar nature during the currency of this bail and they shall mark their presence in the first week of every two months in concerned police station till the trial is concluded. 8. It is also made clear that the petitioners shall not tamper with any evidence nor would influence the witnesses in the case. 9. If any breach of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to him by this Court. 10. Concerned SHO is directed to maintain a register recording the attendance of the petitioners. In case the petitioners fails to mark their presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.
