This petition has been filed challenging the order dated 05.01.2022 passed by Additional District Judge/Additional POCSO Act, Court No. 1, Bulandshahar rejecting the application for interim relief filed in appeal no. 117 of 2019. 3. This Court by order dated 18.04.2022 has stayed the execution proceedings. 4. It has been informed by counsel for both the parties that appeal is at the stage of final hearing. 5. No useful purpose would be served in keeping this petition pending. 6. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to lower appellate court to consider and decide the aforementioned appeal, in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon all the opposite parties and giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment. 7. Since both the parties have agreed that they will cooperate in early disposal of the appeal, it is provided that till the disposal of the appeal, the interim protection granted by this Court shall continue subject to condition that the appellants will not seek undue adjournment to linger on the disposal of appeal. 8. It is made clear that in case, an attempt is being made by the petitioner to linger on the disposal of the appeal, the interim protection granted by this Court, shall automatically be vacated.
