Applicant was being prosecuted for alleged commission of offence punishable under Section 223 IPC through case crime no.96 of 2006, registered at Police Station Wazirganj, District Lucknow as well as the charge sheet no.72 of 2008 dated 26.5.2008, who filed this petition under Section 482 Cr.P.C. to challenge the criminal proceedings and the summoning order dated 15th December, 2012 passed by Special Chief Judicial Magistrate, CBI (AP), Lucknow. On 3rd September, 2021, time was granted to the learned counsel for the applicant to bring on record the legal heirs of the applicant, however, no such application has been filed. Considering the nature of the proceedings, particularly the petition filed before this Court, with the death of the applicant, nothing survives for adjudication and the petition is rendered infructuous.
