JUSTICE BISWAJIT PALIT =O=R=D=E=R= 13.01.2026 This application is filed seeking restoration of the petition being Arbitration Appeal No. 02 of 2025 which was withdrawn by the appellant’s counsel on 29.07.2025. It is contended that the authorization to withdraw the appeal was not there with the counsel who appeared in the matter and that the order passed by this Court has placed the applicant in a precarious position as it had left the applicant remediless in assailing the legality and validity of both the award and the judgment. We are not inclined to accept the contention of the applicant for the reason that the person who withdrew the appeal was a Senior counsel and it is presumed that he had the authority to withdraw the appeal as well. It is impermissible for the applicant to level allegation against the Senior counsel at this point of time and contend that he was not authorized to withdraw the appeal.
