1. Mr. Sanjay Kumar, learned counsel for the petitioner.
2. Mr. N.S. Pundir, learned Deputy Advocate General for the State of Uttarakhand.
3. Mr. Lalit Sharma, learned Deputy Solicitor General for the Union of India.
4. Mr. Sandeep Kothari, learned counsel for the respondent – Uttarakhand Tourism Development Board.
5. A fifteen members committee was constituted by Uttarakhand Tourism Development Board to assess the carrying capacity of river Ganges and in the said meeting, a decision was taken that maximum carrying capacity of river Ganges would be 576 rafts.
6. Petitioner has challenged the decision taken by said committee and he contends that the calculation done by the committee is erroneous, as it takes a raft one minute time to cross a rapid, while committee has taken the said time to be about three minutes.
7. This Court is not inclined to go into the question, as raised by petitioner as it is for the Experts to decide how many rafts can be plied at a given point of time.
8. Since the committee in para 2 of its minutes has observed that 36 kms stretch between Devpryag to Kodiyala
2025:UHC:10642 can be considered for opening for rafting, therefore, the writ petition is disposed of with liberty to petitioner to make representation for opening the said stretch for the purpose of rafting. If petitioner makes such representation to the Competent Authority, the Competent Authority shall have the said stretch technically examined and take decision, as per law, within six months from the date of receipt of such representation along with certified copy of this order.
