HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12637 of 2024 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned AGA for the State. Whereas, no one has put in appearance on behalf of the informant. 2. The accused-applicant seeks bail in FIR/Case Crime No.560 of 2022 under Sections 302 IPC, P.S.- Dhaurahra, District- Kheri. 3. This is the second bail application filed on behalf of the applicant. His first bail application was rejected on 25.04.2024 with a direction to the trial court to conclude trial expeditiously. In the light of the said, learned counsel for the applicant argues that fact witnesses have been examined except one formal witness who is the Investigating Officer. The applicant is in jail since 27.08.2022, having no criminal history. Therefore, he may be enlarged on bail. 4. Learned AGA has opposed the bail application. 5. Considering the fact that there is no material to suggest that the applicant, if being enlarged on bail, can have an adverse effect on the trial of the case in question coupled with the fact that the applicant is in custody since 27.08.2022 and has no previous criminal antecedent, I am of the view that the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed. 6. Let the applicant- Sri Prakash be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and Versus Counsel for Applicant(s) : Dharm Trivedi Counsel for Opposite Party(s) : G.A.
