HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 2036 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in FIR/Case Crime No.316 of 2025, under Section 87 of B.N.S. 2023, Police Station- Tandiyawan, District- Hardoi. Heard learned counsel for the applicant and learned A.G.A. for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. At the very outset, learned AGA has raised a preliminary objection to the maintainability of the present anticipatory bail application, submitting that a Division Bench of this Court has already passed an order dated 26.08.2025 in Criminal Misc. Writ Petition No. 7399 of 2025, which has been brought on record as Annexure No. 3 to the bail application. By virtue of the said order, it has been specifically directed that no coercive steps shall be taken against the petitioner in pursuance of the concerned FIR. It is further pointed out that the said writ petition is still pending adjudication before this Court, a fact which has not been disputed by learned counsel appearing for the applicant. Perused the record. Upon consideration of the submissions advanced by learned AGA, this Court finds that the contention raised on behalf of the petitioner is Versus Counsel for Applicant(s) : Narvind Kumar Singh Counsel for Opposite Party(s) : G.A. Jitendra Yadav @ Natendra .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And Another .....Opposite Party(s)
misconceived. There exists a clear and unambiguous order passed by this Court directing that no coercive steps shall be taken against the petitioner until or unless the Criminal Misc. Writ Petition No. 7399 of 2025 is finally decided or the interim protection granted therein is vacated. The personal liberty of the petitioner thus stands protected by the order dated 26.08.2025 passed in the aforesaid writ petition. In view thereof, there is no imminent apprehension of arrest so as to warrant the grant of anticipatory bail. In view of the observations made hereinabove, the anticipatory bail application is dismissed, as there is no apprehension of arrest. However, learned AGA is directed to inform the concerned investigating officer about the present order as well as the order dated 26.08.2025 passed in Criminal Misc. Writ Petition No. 7399 of 2025.
